Service Description

Lip Sync Video is an AI lip sync video platform that generates talking videos in which a face, photo, or avatar speaks in sync with audio you provide or a script you write. Our Services include:

AI lip sync video generation from a face, photo, or reusable avatar combined with audio or a written script
Talking Photo: turning a single still portrait into a talking MP4 video
Video translation and dubbing across 30+ languages, re-syncing the speaker's mouth to the translated audio
Reusable talking avatars built from a portrait for producing recurring content
User account management and authentication
API access and batch generation for developers (subject to separate API Terms)
Additional features as we may introduce from time to time

Account Registration and Security

Account Creation

You must provide accurate, current, and complete information during registration
You must maintain and promptly update your account information
You are responsible for maintaining the confidentiality of your account credentials
You must immediately notify us of any unauthorized access to your account

Account Eligibility

You must be at least 13 years of age to use our Services
If you are under 18, you must have parental or guardian consent
You must not create an account if we have previously banned or suspended you

Account Security

You are solely responsible for all activities that occur under your account
We are not liable for any loss or damage arising from your failure to maintain account security

Because our Services generate videos from faces and voices, you also represent and warrant that you have obtained all rights, consents, and permissions required from any person whose face, likeness, image, or voice appears in the photos, videos, audio, or scripts you upload. You must not use our Services to impersonate or depict a real person without their consent, or to create content that is deceptive, defamatory, or otherwise unlawful.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Technical Restrictions

Accessing or attempting to access our Services by any means other than through our provided interfaces
Attempting to probe, scan, or test the vulnerability of our systems or networks
Breaching or circumventing any security or authentication measures
Reverse engineering, decompiling, or disassembling any part of our Services
Using automated systems (bots, scrapers) without our written permission

Abuse of Services

Using our Services in a manner that could damage, disable, or impair our infrastructure

Refunds

Credits consumed by successful generations are non-refundable; credits held for a generation that fails due to a problem on our side are returned to your balance automatically
You may cancel a recurring subscription at any time; cancellation takes effect at the end of your current billing period and stops future renewals
Except as described in our Refund Policy or required by law, fees already paid are non-refundable

Termination

Termination by You

You may terminate your account at any time through your account settings
Termination does not relieve you of any obligations to pay outstanding fees
Upon termination, your right to access and use our Services will immediately cease

Termination by Us

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:

Effect of Termination

Limitation of Liability

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

IN NO EVENT SHALL LIP SYNC VIDEO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO loss of profits, data, use, goodwill, or other intangible losses.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless Lip Sync Video and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use or misuse of our Services, your content, or your violation of any third-party rights or applicable laws.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lip Sync Video operates, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to contact us through our contact page and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations within 30 days.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by:

Updating the "Last updated" date at the top of this page
Sending you an email notification (for significant changes)
